A RESOLUTION AUTHORIZING THE CITY MANAGER TO ALLOW THE ECONOMIC DEVELOPMENT PROGRAM AGREEMENT WITH 6 STONES MISSION NETWORK FOR COMMUNITY POWERED REVITALIZATION TO EXPIRE AT THE END OF THE PRESENT TERM. Person presenting this item: Denise Jones, Senior Assistant to the City Manager BRIEF: City Council previously entered into an agreement with 6 Stones Mission Network for a twelve month period to revitalize qualifying residential properties and neighborhoods in the City. The agreement amount of $50,000 provides $25,000 to 6 Stones for project administration and an additional $25,000 for 50% reimbursement of labor and materials invested in the revitalization projects. The current agreement is set to expire September 30, 2018, but will renew automatically for an additional twelve month period unless terminated by either party. The agreement provides for an evaluation at the end of the twelve month period. Staff has evaluated the program and has determined this form of program is still needed; however, with upcoming changes in propertymaintenance codes and an economy that is better suited to develop many of our vacant lots, a different service provider is likely to provide a greater fit with what the City is looking to accomplish. A local non-profit revitalization group from Cleburne has shown a strong interest in partnering with the City. Their intent would be to organize our community to further the repair and rehabilitation efforts of qualifying residential properties at no or lower administrative costs. It is also our opinion that this group would be able to manage a greater quantity of requests for assistance. Details of that proposed agreement will be presented at a later date RS5. A RESOLUTION ESTABLISHING THE CITY’S CONTRIBUTION RATE TO THE CLEBURNE FIREFIGHTERS RELIEF AND RETIREMENT FUND. Person presenting this item: Debra Powledge, Director of Human Resources BRIEF: Unlike all other city employees, our firefighters do not participate in the Texas Municipal Retirement System. Rather, they participate in the Cleburne Firefighters Relief and Retirement Fund (CFRRF). The Mayor (or their designee – City Manager) and the City’s Finance Director serve on the Board of Directors for the CFRRF along with representatives from the membership. During previous budget approvals, the City Council has appropriated funds to this program at a rate equivalent to the current City TMRS (Texas Municipal Retirement System) rate plus 6%. This is currently 16.06 % (TMRS rate) in addition to the 6% for a total of 22.06%. The firefighter’s currently pay into the CFRRF fund 7% (similar to TMRS members) plus an additional 6% for a total of 13%. During the fund’s previous actuarial study it was determined that some changes needed to be made to keep the fund financially viable in to the future. The December 31, 2014 study showed the fund’s unfunded actuarial accrued liability (UAAL) to be at 27.3 years. The December 31, 2016 study, however, showed the funds UAAL to be at 49.6 years. This UAAL, optimally, needs to stay under 30 years. In order to positively reposition the fund, the membership (firefighters) recently voted unanimously to enact changes which include increasing member contributions from 13% to 14%, and an increase in final average salary months used for calculation purposes from 60 to 84. For the City’s part, in order to provide stability and a “smoothing” factor for the fund, our contribution for the next twenty-four months would be at the highest of either 22% or the annual TMRS rate + 6.0%. Funding for the proposed city contribution is included in the fiscal year 2019 budget as previously presented to the City Council. These changes would take effect the first full pay period in October. The changes by the membership, in conjunction with the revised City participation, reduces the projected UAAL amortization period by almost 21 years to a very acceptable 28.7 years. During the next twenty-four months the Board will continue to study and review the fund to address what, if any, additional changes are required to continue to ensure the financial viability of the CFRRF. OR1. AN ORDINANCE AMENDING CHAPTER 97: LIBRARY, SECTION 97.01, LIBRARY FINES AND SECTION 97.03, UNLAWFUL RETENTION OF PROPERTY. AN ORDINANCE APPROVING AN APPLICATION FOR A SPECIAL EXCEPTION USE PERMIT FOR THE REDUCTION OF REQUIRED PARKING SPACES AT 3845 CR 902, AS REQUESTED BY LEECO STEEL. Person presenting this item: Shane Pace, Director of Community Development BRIEF: Section 155.16 to the Code of Ordinances permits an applicant to submit a request for a Special Exception Use Permit, to reduce the required number of parking spaces on a commercial or industrial property. A request has been received from Leeco Steel, for consideration of a Special Exception Use Permit for the property located at 3845 CR 902, in conjunction with a building permit for an expansion of the existing industrial facility. The applicant is proposing to provide 24 parking spaces on the subject property, in lieu of the required 113 spaces. The subject property currently contains one industrial building approximately 73,600 square feet, with nine (9) existing parking spaces. The applicant submitted a building permit to add an additional 38,880 square feet, for a total of 112,480 square feet. Per City Ordinance, 113 total parking spaces are required for the existing building with the proposed expansion, with 39 of these being required with the new expansion. The applicant has indicated the total number of employees on site at any given time will be fifteen (15). Given the large number of required parking spaces, and the limited number of employees the applicant has submitted the formal request for a reduction in parking. Staff has reviewed this request and has no objections at this time. The requested reduction in parking should not adversely impact the operation of the proposed business, nor to the surrounding properties.

HOLD A PUBLIC HEARING FOR PUBLIC INPUT ON THE FY 2019 PROPOSED TAX RATE OF $0.804018 PER HUNDRED DOLLARS OF VALUATION AS REQUIRED BY CHAPTER 26 OF THE TEXAS TAX CODE. Person presenting this item: Terry Leake, Director of Finance BRIEF: Chapter 26, Texas Property Tax Code requires taxing units to comply with “Truth-in –Taxation” laws in setting tax rates. The calculated FY 2019 (Tax Year 2018) effective tax rate is $0.781899. The proposed rate for Fiscal Year 2019 is $0.804018 per $100 of valuation. On August 14, 2018, the City Council adopted a resolution stating its intent to adopt a tax rate of $0.804018. This rate is unchanged from Fiscal Year 2018; if adopted, would be the sixth straight year with this proposed tax rate. As this current and proposed tax rate of $0.804018 is higher than the effective tax rate of $0.781899, legislation requires that the City Council hold two public hearings to provide the public the opportunity to speak on the proposed tax rate. This is the first of the two public meetings on the proposed tax rate, prior to the meeting to adopt the tax rate. The second meeting will be held on Tuesday September 4, 2018 at 5:00pm, during the regularly scheduled council meeting. As required by law, the City published the attached “Notice of 2018 Tax Year Proposed Property Tax Rate for the City of Cleburne” on August 18, 2018 in the Cleburne Times-Review. As a point of reference, the effective tax rate sets the interest and sinking rate (Debt Service rate) at $0.151364. The remainder of the tax rate of $0.652654 will be allocated to operations and maintenance (General Fund rate). The ordinance adoption the Fiscal Year 2019 tax rate will reflect these rates, as required by the effective tax rate calculation. AN ORDINANCE APPROVING AN APPLICATION FOR A SPECIAL EXCEPTION USE PERMIT FOR THE REDUCTION OF REQUIRED PARKING SPACES AT 3845 CR 902, AS REQUESTED BY LEECO STEEL. Person presenting this item: Shane Pace, Director of Community Development BRIEF: Section 155.16 to the Code of Ordinances permits an applicant to submit a request for a Special Exception Use Permit, to reduce the required number of parking spaces on a commercial or industrial property. A request has been received from Leeco Steel, for consideration of a Special Exception Use Permit for the property located at 3845 CR 902, in conjunction with a building permit for an expansion of the existing industrial facility. The applicant is proposing to provide 24 parking spaces on the subject property, in lieu of the required 113 spaces. The subject property currently contains one industrial building approximately 73,600 square feet, with nine (9) existing parking spaces. The applicant submitted a building permit to add an additional 38,880 square feet, for a total of 112,480 square feet. Per City Ordinance, 113 total parking spaces are required for the existing building with the proposed expansion, with 39 of these being required with the new expansion. The applicant has indicated the total number of employees on site at any given time will be fifteen (15). Given the large number of required parking spaces, and the limited number of employees the applicant has submitted the formal request for a reduction in parking. Staff has reviewed this request and has no objections at this time. The requested reduction in parking should not adversely impact the operation of the proposed business, nor to the surrounding properties.
AN ORDINANCE AMENDING TITLE V, PUBLIC WORKS, CHAPTER 51, WATER AND SEWERS, SECTION 51.052, WATER AND SEWER CONNECTION CHARGES (A). Person presenting this item: Jeremy Hutt, Director of Public Works BRIEF: The current ordinance establishes that; • The City of Cleburne will install and maintain all house laterals from the city sewer mains to the nearest property or easement line, and all water service connections from the city water main to the nearest property or easement line. • The City shall charge for the installation and maintenance of such sewer house laterals and water services a sum sufficient to cover the average cost thereof, plus the cost of the electronic water meter (meter will be the property of the city), which shall be charged at and on the following rates or basis: • (1) Sewer lateral connection charge. As established by the City of Cleburne Ordinances the City installs the new services taps and incurs the costs of doing the installation of the tap. Upon review of the current fee structure and the incurred costs of the associated work orders, staff is recommending the removal of the “Tie on” fee. This will reduce some of the costs for an applicant that is requesting a new service, yet will not affect the effort to recover costs associated with the installation of a new tap. HOLD A PUBLIC HEARING FOR PUBLIC INPUT ON THE FY 2019 PROPOSED TAX RATE OF $0.804018 PER HUNDRED DOLLARS OF VALUATION AS REQUIRED BY CHAPTER 26 OF THE TEXAS TAX CODE. Person presenting this item: Terry Leake, Director of Finance BRIEF: Chapter 26, Texas Property Tax Code requires taxing units to comply with “Truth-in –Taxation” laws in setting tax rates. The calculated FY 2019 (Tax Year 2018) effective tax rate is $0.781899. The proposed rate for Fiscal Year 2019 is $0.804018 per $100 of valuation. On August 14, 2018, the City Council adopted a resolution stating its intent to adopt a tax rate of $0.804018. This rate is unchanged from Fiscal Year 2018; if adopted, would be the sixth straight year with this proposed tax rate. As this current and proposed tax rate of $0.804018 is higher than the effective tax rate of $0.781899, legislation requires that the City Council hold two public hearings to provide the public the opportunity to speak on the proposed tax rate. This is the first of the two public meetings on the proposed tax rate, prior to the meeting to adopt the tax rate. The second meeting will be held on Tuesday September 4, 2018 at 5:00pm, during the regularly scheduled council meeting. As required by law, the City published the attached “Notice of 2018 Tax Year Proposed Property Tax Rate for the City of Cleburne” on August 18, 2018 in the Cleburne Times-Review. As a point of reference, the effective tax rate sets the interest and sinking rate (Debt Service rate) at $0.151364. The remainder of the tax rate of $0.652654 will be allocated to operations and maintenance (General Fund rate). The ordinance adoption the Fiscal Year 2019 tax rate will reflect these rates, as required by the effective tax rate calculation. The proposed FY 2019 tax rate is scheduled for City Council adoption at the regularly scheduled council meeting on September 11, 2018 at 5:00 p.m. ADJOURNMENT
